Subject: What a RIPOFF!

We too were fooled by Beaverhomes. Unfortunately, at the time we found them on the web, they were sporting the BBB symbol on their site.
We ordered a large quanity (over 1500 sq ft) of Macaranduba Trinty flooring last October/2001. We were promised our flooring would be delivered by the end of January. While we waited, they sent us a box of wood samples assuring us the best quality and we even ordered the tape on how to lay the floor (a big waste of video). January came and went, then February, March. During these months, I sent them over 12 emails and yet no one would respond. I was beginning to think they went bankrupt and we were going to lose our deposit (over $3000.00). We called them several times and finally got an answer but not the one we wanted. We were told they didn't even have the wood, it was delayed in Brazil, but a shippment magically appeared in a Massachuttes warehouse so our order will be filled ASAP. So all this time, while we were getting occasional emails telling us how the process was going, THEY WERE LYING TO US! Larry Beaver finally admitted he didn't know how to tell us the wood wasn't there so he just didn't response to my email. We then talked to the "Big Beaver: Neal he BEGGED US not to cancel our order and even refunded the shipping cost to us. They said the order would be shipped at the end of April (the date they PROMISED we would have our flooring), so we agreed not to cancel. We contacted them at the end of April only to be told the wood was too wet and was still in the kiln (a line they handed us quite frequently over the last 6 months). According to their accounts, our wood was in the kiln over 3 times! Now I'm being told it's in the kiln again and it won't be ready until the end of June. We demanded our money back and was told it would take another 30 days. That too was a lie. When the credit didn't appear on our credit card we called and was told that they are no longer working with the credit card companies (they had sense enough to cut them off) and we need to file a claim with our credit card company. That's when I started researching the NY State BBB and AG's Office web sites and found that on May 7th, 2002; the AG's office settled a suit against Beaverhomes for shady business practices and made them set up a escrow account so customers who wanted refunds could get their money back.
This is the kind of company that makes it hard for small, HONEST, internet startups to make it. All along we were told about the quality and how hard they were working to please the customer. This customer only wanted the flooring, delivered when promised and we would have been happy. As of now, our fate and a large amount of money, is in the hands of the credit card company. We had already contacted the NY State AG's office and they are willing to assist us after we have exhausted all the normal routes of trying to resolve this. And we are still paying (monthy) for something we don't have, which makes it all the more maddening.
I will leave you all with this part shot from "the BEAVERS". We received a letter from their accounting office which reads,
"We all here at BeaverHome.com would like to thank you for the opportunity to have served you"....All of us here at BeaverHome would again like to thank you for your support in the past, and hope that we may assist you with a project in the future". NOT A CHANCE!!!!!!
Thanks for letting me vent........

I too had ordered some Brazilian cherry flooring from Beaverhome. And I did get my first shipment after 6 months of badgering them. I also had the advantage of living near their warehouse, so I sent my contractor to pick the wood up. A majority of the flooring was crap, 50% of it had to be culled out and returned. I hear that they send these returned pieces to out of town customers. Anyway, after being installed for 2 months, the floor is now delaminating; I have the engineered Trinity version. Neal, the "the big beaver" says to tear it out at my expense, return it, and he will refund my money. Based upon their refund history, I don't believe that I would ever see the money.

Anyway, the beavers left town to find more suckers down south. I have not seen the rest of my wood or received a refund of my outstanding balance.

You can sue Neal Martin and his son, Cole, under the racketeering act (RICO) and get treble damages.

A recent victim of these two hucksters sued Neal and Cole Martin in the Georgia court system and won. She received a cashiers check for her full restitution.(approx $8,000.00) Both Neal and Cole were in court. While doing some research, she found out that Neal and Cole plead guilty to wire fraud in the NY Western District Court which nobody seemed to know about.

Neal and Cole are due to be sentenced on 3-24-05. Anyone who lives in the Buffalo NY might want to go!! Both Martins should receive some jail time for this.

One of their victims went after them under the RICO act, which allows you to sue for triple damages as well as triple attorney fees.

Cole is working at the Mall of Georgia. He lives in Gainesville, GA. Last known address:

1305 Calvery Church Rd.
Gainesvulle GA 30507

He moved there in Jan. 2004. He was previously at 1635 B. Calvery Church Rd. in Gainesville GA. That time was sometime around May 2003 to Jan 2004. Prior to that he was at a Suwannee, GA location.

He did file a Chapter 13 in Jan. 2002 in the US Bankruptcy court in Gainesville. Docket # 0430003. Perhaps he will have to sell his Black Cadillac Escalade.

He lives in a million dollar home on Lake Lanier. However, what a surprise, he screwed his contractor out of a lot of money. Well over $50,000.00.

One other interesting note, he supposedly hires work release prison inmates.

A woman who was involved in a dealing with Peter Fishman claims she was swindled out of $175,000 and that Fishman is being investigated by the State of Georgia as well. There's a connection with Fishman and one of Neal's lawyers - Lenny Franco.

If you were taken by any of these fraud artists, sue the living hell out of them!
